Terms of Service.

Please read these Terms carefully before using eshtery.com (the “Service”). By accessing or using the Service you confirm you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.

1. About eshtery

eshtery.com is operated by Mahmoud Awad, an individual based in California, United States (“eshtery,” “we,” “us,” or “our”). eshtery is an editorial publication and directory of independently owned modest-fashion brands from the Middle East, North Africa, and abroad. We are not a marketplace, not a retailer, and not a payment processor. We do not stock inventory, ship merchandise, accept returns, or hold any funds on behalf of brands or shoppers.

The Service may include: brand-profile pages, editorial dispatches, an AI-assisted search experience (“Ask the editor”), a searchable index, a newsletter, and trackable outbound links to third-party brand websites where transactions are completed.

2. Eligibility

You must be at least 16 years old to create an account or use features that require sign-in. By using the Service you represent that you have the legal capacity to enter into a binding agreement and that your use of the Service does not violate any law in your jurisdiction.

3. Accounts

You may create an account using a third-party identity provider (Google, Facebook) or by email. You are responsible for the accuracy of information you provide, for safeguarding any access credentials, and for activity under your account. Notify us at m@eshtery.com immediately if you suspect unauthorized access.

We reserve the right to suspend or terminate an account at our discretion, including for violation of these Terms, misuse of the Service, or where required by law. Termination does not relieve you of obligations accrued before termination.

4. Editorial position

eshtery selects brands based on editorial judgment. Inclusion is not a guarantee of quality, availability, fit, authenticity, or any other attribute of a brand's products. Editorial notes reflect our subjective view and are not statements of fact about any brand's business.

Every transaction completes on a brand's own website under that brand's own terms. We are not a party to any sale. Issues with payment, fulfillment, sizing, quality, returns, refunds, warranty, or customer service must be addressed to the brand directly.

5. Affiliate and partnership disclosure

eshtery may receive compensation from brands featured on the Service, including (but not limited to) commission on purchases made via outbound links, fixed listing fees, sponsorship of editorial features, or other arrangements. We disclose any such relationship that may meaningfully influence a reader's decision in the editorial register required by the U.S. Federal Trade Commission's endorsement guides (16 CFR § 255). Editorial judgment is not influenced by compensation: we feature brands we believe in regardless of partnership status, and decline brands we don't regardless of payment offered.

6. Acceptable use

You agree NOT to:

  • Use the Service for any unlawful, deceptive, or harmful purpose.
  • Attempt to access non-public areas, scrape the catalog or editorial content at scale, or circumvent any rate-limit, authentication, or technical protection measure.
  • Use automated tools (bots, crawlers, scripts) to interact with the Service except for documented public endpoints (robots.txt, sitemap.xml).
  • Impersonate any person or misrepresent your affiliation with any person, brand, or organization.
  • Submit false, misleading, or fraudulent information through the brand-application form, brief feature, or any other input.
  • Use the Service to send unsolicited communications, advertise, or promote any third-party product, service, or website.
  • Reverse-engineer, decompile, or attempt to extract source code, machine-learning models, embeddings, or proprietary editorial content.

7. User-submitted content

The Service lets you submit content in several places: brand applications at /for-designers; saved briefs at /account/briefs; wishlist entries; profile preferences; and questions to /ask.

You retain ownership of content you submit. By submitting, you grant eshtery a worldwide, non-exclusive, royalty-free, sublicensable license to use, store, reproduce, modify, display, and distribute your submission for the purposes of operating the Service, improving our editorial processes, and (where you have opted in) delivering personalized communications. We may decline, edit, or remove any submission for any reason, including editorial fit.

You represent that submitted content is yours to license, does not violate any third-party right (including intellectual property, privacy, or publicity), and is not unlawful, defamatory, or obscene.

8. eshtery's intellectual property

The Service's name, logo, design system, editorial copy, editorial notes, AI prompts, software, and arrangement of content are owned by eshtery and protected by U.S. and international intellectual-property laws. Brand names, logos, and product imagery are owned by the respective brands and used by eshtery under editorial fair use or with brand permission. Nothing on the Service grants you any license to any of these except the limited right to access and use the Service as expressly permitted by these Terms.

9. Third-party sites and services

The Service contains links to third-party websites operated by brands and other parties. eshtery does not control these sites, does not endorse their content, and is not responsible for their terms, privacy practices, security, accuracy, or any transactions conducted on them. Your interactions with third-party sites are governed by those sites' own terms.

The Service relies on third-party providers including (without limitation) Vercel (hosting), Supabase (database, authentication infrastructure), Clerk (identity), Resend (email delivery), Anthropic (AI assistance), and Voyage AI (semantic embeddings). Use of those providers is governed by their own terms.

10. AI-generated content

The “Ask the editor” feature uses a large language model to produce suggestions and editorial-voice prose. Large language models can produce inaccurate, incomplete, or invented information (commonly called “hallucination”). Suggestions are presented for your consideration only and are not professional advice. Verify any factual claim independently before acting on it, especially price, availability, sizing, or material composition.

11. Disclaimer of warranties

The following section is in uppercase to comply with conspicuous-disclaimer requirements under California law.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO REPRESENTATION OR WARRANTY ABOUT ANY BRAND, PRODUCT, OR THIRD-PARTY WEBSITE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL ESHTERY OR ITS OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, ANY THIRD-PARTY SITE LINKED FROM THE SERVICE, OR ANY CONTENT OBTAINED FROM THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100).

Some jurisdictions do not allow certain liability limitations, in which case the limitations above apply to the maximum extent permitted by applicable law.

13. Indemnification

You agree to indemnify, defend, and hold harmless eshtery, its operator, and its service providers from and against any claim, loss, damage, liability, or expense (including reasonable attorneys' fees) arising out of or related to your use of the Service, your submitted content, your violation of these Terms, or your violation of any law or third-party right.

14. Governing law and venue

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service shall be brought exclusively in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction and venue in those courts. Nothing in this section prevents either party from seeking injunctive or other equitable relief in any court of competent jurisdiction.

15. Changes to the Service or these Terms

We may modify the Service at any time, including adding or removing features, brands, or categories. We may update these Terms by posting a revised version at this URL and updating the “Last updated” date above. Material changes will be notified by email to signed-in account holders or by a prominent notice on the Service. Your continued use of the Service after a change constitutes acceptance of the revised Terms.

16. Severability and entire agreement

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. These Terms, together with the Privacy Policy and any additional terms you agree to in connection with a specific feature, constitute the entire agreement between you and eshtery regarding the Service.
